By accessing or using aufguss.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Description of service

aufguss.app is a platform for discovering, learning, and sharing the art of Aufguss. The service includes video sessions, community features, creator tools, and subscription-based content.

3. User accounts

• You must register an account to access most features. Registration requires a valid email address.
• You are responsible for providing accurate and up-to-date information.
• You are responsible for maintaining the security of your account credentials. Do not share your password.
• Each person may only maintain one account. Duplicate accounts may be terminated.

4. Acceptable use

You agree to use the service in a lawful and respectful manner. You must not:

• Violate any applicable laws or regulations.
• Harass, abuse, or harm other users or post offensive content.
• Scrape, crawl, or use automated tools to access the service without permission.
• Upload malicious software, viruses, or any harmful code.

5. User content

You retain ownership of content you create or upload. By posting content on the platform, you grant us a non-exclusive, worldwide license to display and distribute it within the service. You are solely responsible for the content you publish and must ensure it does not infringe on the rights of others.

6. Intellectual property

The aufguss.app platform, including its design, code, logos, and original content, is protected by copyright and intellectual property laws. You may not copy, modify, or redistribute any part of the platform without written permission.

7. Subscriptions and payments

Creators on the platform offer paid subscription groups using their own Stripe accounts. When you subscribe to a creator's group, your payment is processed directly by the creator's Stripe account - aufguss.app does not process or handle your payment. The platform takes no fees or commissions. Subscriptions renew automatically unless cancelled before the renewal date. For refund requests, please contact the creator directly, as they are the merchant of record for your payment.

8. Creator responsibilities

Creators who offer paid subscription groups are solely responsible for their own Stripe account, payment processing, tax compliance, invoicing, VAT collection and remittance, accounting, and adherence to all applicable laws in their jurisdiction. aufguss.app is not a payment processor, does not hold funds, and bears no liability for creators' financial or tax obligations. Creators must ensure their Stripe account is properly configured and maintained. The platform provides the technical infrastructure for subscription management but does not participate in the financial transaction between creators and subscribers.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through your account settings. Upon termination, your personal data will be handled in accordance with our Privacy Policy.

10. Limitation of liability

The service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

11. Governing law

These terms are governed by the laws of the European Union and the member state in which the service operator is established. Any disputes shall be resolved in the competent courts of that jurisdiction. As an EU consumer, you may also be entitled to use the European Online Dispute Resolution platform.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of the service after changes constitutes acceptance of the updated terms.
